PRIVACY POLICY

everwise LLC (“everwise”, “we”, “us”) is a company incorporated under the laws of Switzerland under number CHE-401.518.460 and having its registered office at Route d’Arnier 14, 1092 Belmont-sur-Lausanne, Switzerland. everwise acts as the “controller” for the Personal Data that are processed under, or in connection with, this Privacy Policy. “You” means any natural or legal person interacting with everwise, regardless of medium. Here you will find an overview of how we process your Personal Data, the purposes for which we process it, and how you benefit. You will also see what your rights are and how you can contact us. This Policy covers both our online and offline data collection activities, including Personal Data that we collect through our various channels such as websites, social network, contact forms, discussions, or events. We might aggregate personal data from different sources (website, offline event). Our goal with this policy is to be as clear as possible. What data do we collect?
  • The Personal Data that you give to us (for instance name, surname, e-mail and all other information shared with us, when you contact us, provide feedback, fill in a form, send us an email, call/meet us, share content on a everwise site or social media platform). The data that we create, for instance, when you request a service. Data collected from other legitimate sources such as everwise partners, network, from public sources, data from your interaction with our advertising, or Personal Data that is part of your profile on a social network and that you have made available to us. Cookies, as detailed hereunder in the Cookies section.
When you visit any page on the everwise website, some technical information is automatically collected, such as:
  • Geo-location data. We record (via IP addresses and time stamp) from where in the world you are accessing the website.
  • Log data. We record information, known as log data, including browser interaction data and other information that your device’s browser automatically sends to any website you visit. This log data includes your IP address, which browser you are using and its settings, the date and time of your request, and data on how you used our website, “cookie” data and information about your device.
  • Device information. We collect information on the type of device you are using, its operating system, browser type and version and other information to enable us to ensure that our website operates properly with your device. This may include information unique to your device. The information your device sends to us depends on its manufacturer.
  • Website tracking and improvement data. We may log the manner in which visitors to our website navigate our website. This is done to improve the usability of our website and to track the success of our communications and promotions.
  • Browsing history of registered users on our websites. This enables us to understand better the interests of our registered users.

  • Payment information. We or our relevant contractors may, depending on your choices, retain your payment information.

Why do we process your Personal Data?

We process your Personal Data to

  • communicate with you,
  • perform the Service,
  • conduct surveys aimed at providing you with better services,
  • proceed to invoicing
  • inform you of everwise activities, events and opportunities,
  • answer your queries and
  • provide you with communications about everwise and our Services.

We also process your Personal Data in order to help us comply with the law, to sell or transfer any relevant part of our business, to manage our systems and finances, to conduct investigations and to exercise legal rights. We combine your Personal Data from all sources so that we can understand you better to improve and personalise your experience when interacting with us.

Who can access your Personal Data and why?

We limit the disclosure of your Personal Data to others, however we do need to disclose your Personal Data in certain instances and mainly to the following recipients:

  • Third parties engaged by us to provide services such as administering everwise websites and services available to you, subject to appropriate protections;
  • Credit reporting agencies/debt collectors, where permitted by the law and if we need to verify your creditworthiness or collect outstanding invoices; and
  • Relevant public agencies and authorities, if required to do so by law or a legitimate business interest.

Transfer of your personal data

Everwise operates globally. We may therefore process your Personal Data outside of the country in which you are based, including countries outside the European Economic Area, for the purposes set out in this notice. When we transfer your Personal Data to other countries, we take reasonable steps to ensure that applicable laws are being followed. We also rely on European Commission and Swiss government adequacy decisions about certain countries, as applicable, for data transfers to countries outside the EEA. This may include reliance on bilateral privacy shields.

 

Data security and retention

We use a variety of measures to keep your Personal Data confidential and secure, including restricting access to your Personal Data on a need to know basis and following appropriate security standards to protect your data.
We take every reasonable step to ensure that your Personal Data is only processed for the minimum period necessary in connection with: (i) the purposes set out in this Privacy Notice; (ii) any additional purposes notified to you at or before the time of collection of the relevant Personal Data or commencement of the relevant processing; or (iii) as required or permitted by applicable law; and thereafter, for the duration of any applicable limitation period.
We control physical access to our premises. We work to ensure that our contractors have in place appropriate security measures and process data in accordance with applicable laws.

Cookies Cookies are small pieces of text sent to your browser by a website you visit and from your browser back to the website. everwise uses cookies. Some cookies last only for the duration of your visit (these are called “session cookies”), while others remain on your computer until they expire or are deleted (known as “persistent cookies”). Cookies do not themselves identify you, but we may link information identifying you (for example your IP address) to a cookie on your browser. We use cookies to:
  • Apply any preferences you may have indicated
  • Track your navigation of our website (without identifying you) so we can analyse the usability of our website and improve it, and so that we can understand your interests and thus only send you information relevant to you
  • Secure your data when communicating with our website.
All everwise cookies are used only in the everwise.ch domain. We may also use third-party analytics cookies such as Google and other third-party Analytics (see dedicated section in this Privacy Policy). For further information on this, please see the above sections on Analytic Services. You may refuse the use of cookies by selecting the appropriate settings on your browser; however, if you do this, you may not be able to log in or use the full functionality of everwise’s websites.

Analytic Services

everwise may use Google Analytics, a web analytics service provided by Google. Google Analytics uses cookies (see the section below on cookies) to allow us to analyse your use of our website. The information generated by the cookie regarding your use of this website will, as a rule, be transmitted to and stored on a Google server in the US. Information sent by everwise to Google Analytics does not personally identify any resident of Switzerland, the EU or EEA. In exceptional cases your full IP address may be transmitted to a server of Google in the US and shortened there. Google will use this information on our behalf to analyse your use of our website, to compile reports on website activities and provide additional services relating to website use and internet use to the website operator. The IP address collected through Google Analytics from your browser will not be merged with any other data held by Google.
You may also prevent Google from collecting and storing information in cookies, from storing information about your use of the website (including your IP address) and from processing such information by downloading and installing the browser plug-in available here.

We may also use other selected third-party web analytics services, also sometimes referred to as “pixels”, with services such as Twitter, Google and Facebook.

What are your rights over your Personal Data?

Your Personal Data will only be processed for the purposes set out in our Privacy Notice, or any other further purposes notified to you before the processing begins. If you choose not to provide Personal Data when we ask you, this may limit the services we can offer you.
If you share Personal Data with us, you have a right to (i) request access (i.e. to ask us what data we have about you, and obtain a copy), (ii) ask for changes to be made in case of errors or (iii) ask to have the data deleted. This can be done by contacting us on data@everwise.ch

Age limits and children everwise is focused on professional services for people aged 18 and over. Where individuals aged less than 18 are involved in everwise, everwise only communicates with them via parents or legal representatives. Direct interactions are only possible if based on a valid prior authorisation from a legal representative.
